Welcome to COLO BIRD: Uninterrupted Reliability.
Before creating an account or provisioning any of our infrastructure, please review this document carefully. These Terms of Service outline essential information regarding your rights, responsibilities, and our commitment to keeping you online without interruption. By registering for our services, you agree to abide by these terms.

Introduction

These terms and conditions apply to all services provided by www.colobird.com and its affiliated entities. COLO BIRD, also referred to herein as the "Company," is a legally registered corporate entity. These terms govern all clients (referred to as "Subscribers") associated with this Company, whether they are paid subscribers or recipients of services from COLO BIRD or its affiliates. By using our services, you explicitly agree to the following terms:

1. Age Restrictions for Clients

1.1 Age Requirement: Any client placing orders through the COLO BIRD online system must confirm and guarantee they are at least 18 years old and possess the legal capacity to enter into this agreement.

1.2 Age Restrictions: If a client is below 18 years of age, they must promptly inform us and terminate their services. They are prohibited from using any further services provided by COLO BIRD without proper authorization.

1.3 Clients Under 18: Minors under 18 must obtain explicit consent from a parent or legal guardian to access this site and engage in our services. COLO BIRD disclaims all liability and responsibility regarding legal issues or difficulties arising from age misrepresentation.

2. Access, Limitations, and Restrictions

2.1 Access Requirements: Before accessing COLO BIRD's control panels, you must provide personal information, which is safeguarded in our records. All provided information must be complete, accurate, and truthful. We reserve the right to refuse service if data is erroneous, omitted, or falsified. Furthermore, we retain the authority to suspend or terminate access at any time, without a refund, if fraudulent activity is suspected.

2.2 Limited Usage License: Subject to these Terms and Conditions, COLO BIRD grants you a limited, non-exclusive, non-transferable personal license to access and utilize our services. Our services are exclusively for private and authorized commercial purposes; unlawful use is strictly prohibited. You must prevent any unauthorized intrusion or misuse of our services. We reserve the right to enforce network security measures and bandwidth limits. Unauthorized use will result in immediate license termination, and violators may face legal prosecution to the fullest extent of applicable law.

3. Know Your Customer (KYC) & Identity Verification

To maintain a secure, compliant, and trustworthy infrastructure, COLO BIRD enforces a mandatory KYC policy.

3.1 Required Information: Customers must submit accurate, original details, including: Full Name, Email Address, Phone Number, Physical Address, Country, and Postal Code.

3.2 General Policies: Orders placed via VPNs, Proxies, or Tor networks will be automatically flagged and rejected. If fake or inaccurate information is detected, you will be granted one opportunity to correct and resubmit your details using a valid government-issued ID and biometric verification.

3.3 Refund Policy on KYC Failure: If you fail to provide valid KYC details, refunds will strictly be issued ONLY for payments made via Visa, Mastercard, and American Express (Amex). Payments made via Cryptocurrency, alternative gateways, or other non-reversible methods are strictly non-refundable upon KYC failure. If KYC fields are intentionally left blank or populated with fake information, your account will be permanently banned. All funds associated with the banned account will be frozen, and no refunds will be issued under any circumstances.

3.4 Privacy Guarantee: COLO BIRD is fully committed to your security. Your personal information will never be sold, leaked, or shared with unauthorized third parties.

4. Billing, Payments, Refunds, and Subscriptions

4.1 Billing Process: COLO BIRD will only initiate the setup of chosen services upon receipt of full payment. Invoices are generated at least 14 days before the due date. Prompt payment is the subscriber's responsibility.

4.2 Payment Options: We accept Credit Cards, Crypto (Bitcoin/USDT), Wire Transfers, and other verified methods. If an account holds an outstanding balance for more than 24 hours, COLO BIRD reserves the right to suspend or terminate services until the balance is cleared.

4.3 Refund Policy: COLO BIRD does NOT issue refunds, except in instances covered by our Service Level Agreement (Section 11) or in cases of a proven billing discrepancy.

4.4 Automated Subscriptions: When paying via Credit Card, you consent to an automated subscription that activates upon purchase. Funds will be deducted automatically on the due date. We do not refund automated renewals. To cancel, you must use your client portal or submit a support ticket prior to the renewal date.

4.5 Set-Up Fees: Standard set-up fees for dedicated server rentals are waived unless custom third-party requirements necessitate an additional charge.

5. Services Offered

5.1 Dedicated / Bare Metal Servers: High-performance server solutions with customizable processing power, RAM, and storage specifications.

5.2 Colocation Services: Comprehensive colocation including power supply, cabinet space, uplink connections, and IP allocations.

5.3 DDoS Mitigation: Robust Level 3 ingress traffic filtering to defend against Layer 1 through 6 DDoS attacks.

5.4 IP Transit Services: Diverse, global IP transit connectivity options for our colocation subscribers.

6. Copyright and Intellectual Property Rights

All materials accessible across our network remain the proprietary information of COLO BIRD. We have a zero-tolerance policy for copyright infringement. You may not copy, distribute, modify, or transmit our website content without prior written consent. Utilizing our services grants you no intellectual property or ownership rights over our materials.

7. Unacceptable Content and Activities (AUP)

To ensure the security and integrity of our global network, COLO BIRD enforces a strict Acceptable Use Policy (AUP). Using our services to host, store, transmit, or promote the following is strictly prohibited:

7.1 Network Abuse and Cybercrime

  • IP Spoofing / Header Forgery: Concealing traffic origins by forging IP addresses, packet headers, or email headers.
  • Denial of Service (DDoS/DoS): Initiating, facilitating, or participating in network flooding or DDoS attacks.
  • Malware / Command & Control (C2): Hosting, distributing, or executing malicious software (viruses, trojans, ransomware) or running C2 servers.
  • Network Probing / Scanning: Unauthorized port scanning, vulnerability probing, or brute-force attacks against our network or third parties.
  • Phishing / Credential Harvesting: Hosting fraudulent sites, fake login pages, or operating identity theft schemes.

7.2 Illegal and Harmful Content

  • Child Sexual Abuse Material (CSAM): Zero-tolerance. Hosting or distributing child exploitation material will result in immediate termination and reporting to law enforcement.
  • Terrorism / Extremism: Promoting, encouraging, or instructing acts of terrorism, violence, or weapon creation.
  • Human Trafficking: Facilitating or promoting human trafficking or illegal prostitution.
  • Illegal Substances: Selling, distributing, or promoting illegal drugs, contraband, or unlicensed prescription medications.

7.3 Fraud and Financial Crimes

  • Carding / Stolen Data: Storing, distributing, or selling stolen credit card info, compromised identities, or leaked databases.
  • Ponzi Schemes / HYIPs: Hosting fraudulent cryptocurrency platforms, pyramid schemes, or High-Yield Investment Programs.
  • Fake E-commerce: Operating deceptive business practices or fraudulent online stores.

7.4 Email Abuse and Spam

  • Unsolicited Commercial Email (UCE): Sending bulk, unsolicited spam or running mailing lists without verifiable opt-in consent.
  • Mail / SMS Bombers: Hosting scripts designed to overwhelm inboxes or phones.
  • Blacklisting: Any activity causing our IPs to be blacklisted on global databases (e.g., Spamhaus, SORBS).

7.5 Intellectual Property Violations

  • Warez / Pirated Software: Hosting or distributing unauthorized copyrighted material, nulled scripts (e.g., nulled WHMCS/cPanel/Windows), cracks, or keygens.

7.6 High-Risk and Resource-Abusive Activities

  • Tor Exit Nodes: Operating Tor exit relays, which attract high abuse complaints.
  • Open Resolvers / Proxies: Running unsecured or public Open DNS resolvers/Proxies capable of amplification attacks.

Strict Enforcement & Zero-Tolerance Protocol

Violation Consequence: We actively monitor network traffic for abuse. If any account violates this AUP (including hosting illegal MP3s, warez, or hacker programs), COLO BIRD reserves the absolute right to immediately suspend, wipe, or permanently terminate the offending server/account without prior notice.

No Refund Policy: Under no circumstances will a refund be issued for services terminated due to a TOS violation.

Law Enforcement Notification: All malicious activities (Dark Web operations, Ransomware, CSAM, etc.) will result in immediate server seizure. Your IP logs, connection history, and complete KYC verification details will be unconditionally surrendered to local law enforcement and international cybercrime units for prosecution.

8. Unpaid Invoices & Service Suspension

8.1 Equipment Collateral: COLO BIRD reserves the right to assume ownership of colocated equipment if an account remains overdue for more than 30 days.

8.2 Termination due to Breach: Failure to make timely payments or any violation of this agreement may result in immediate service suspension or termination. Upon termination, we reserve the right to securely wipe all data stored on the servers.

9. Upgrades and Setup Procedures

9.1 Upgrades: Requested upgrades will take effect at the beginning of your next billing cycle, unless an immediate upgrade is requested and fully paid for in advance.

9.2 Setup Time: Standard setups are processed within 24 hours. Provisioning times for dedicated servers may vary depending on hardware availability.

10. Cancellations

Cancellations must be submitted via a verified support ticket at least 24 hours prior to the upcoming billing due date. By canceling, you acknowledge liability for all charges incurred up to the date of termination. No pro-rated refunds are issued for mid-cycle cancellations.

11. Service Level Agreement (SLA) & Satisfaction Guarantee

COLO BIRD guarantees a 99.99% network uptime. If we fail to meet this guarantee due to internal network faults, you may be eligible for service credits. Setup fees are strictly non-refundable. Clients experiencing technical difficulties must contact our support team immediately for resolution.

12. Limitation of Liability and Data Loss (IMPORTANT)

12.1 Data Backups: COLO BIRD does not perform automatic backups of client data unless a specific managed backup service has been purchased. The subscriber bears sole responsibility for maintaining independent, off-site backups of all data stored on our infrastructure.

12.2 Liability: Under no circumstances shall COLO BIRD, its directors, or its employees be held liable for hardware failure, hardware degradation, data loss, security breaches, loss of profits, or indirect business damages resulting from the use or inability to use our services.

13. Force Majeure

COLO BIRD shall not be held liable for any delay or failure to perform its obligations under this TOS if caused by events beyond our reasonable control. This includes, but is not limited to: acts of God, natural disasters, wars, terrorism, government restrictions, power grid failures, or massive global internet outages.

14. Amendments to the Terms of Service

COLO BIRD reserves the right to amend these Terms and Policies at any time. Changes become effective immediately upon posting the updated TOS on our website. Your continued use of COLO BIRD services following any updates constitutes your explicit acceptance of the revised terms. If you do not agree with the amendments, you must submit a cancellation request immediately and cease using our services.

15. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located within the United States.
